1. Who we are and what these Terms cover

1.1. GerBnB operates an online platform (the "Platform") that connects independent Mongolian herder and nomadic-family hosts (each a "Host") with travellers who wish to book a stay in a traditional ger (each a "Guest"). The Platform is available at gerbnb.mn and related applications.

1.2. GerBnB is an intermediary, not an accommodation provider. We do not own, operate, manage, or control any ger, camp, or property. The stay itself is provided by the Host. The accommodation contract is formed directly between the Guest and the Host; GerBnB is not a party to it.

1.3. What we charge for. GerBnB collects only a 10% deposit at booking, which is our service commission (see §4). The price of the stay itself is paid by the Guest directly to the Host at check-in. GerBnB never collects, holds, or pays out the price of the stay.

1.4. By creating an account, listing a stay, or making a booking, you agree to these Terms of Service (the "Terms"), our Privacy Policy, and our Cookie & Consent Notice. If you do not agree, do not use the Platform.

1.5. These Terms apply to all users — Guests and Hosts alike. Section 5 adds terms that apply only to Guests; Section 6 adds terms that apply only to Hosts.

2. Eligibility and accounts

2.1. You must be at least 18 years old and able to enter into a binding contract under Mongolian law. The Platform is not directed to children.

2.2. You must provide accurate, current information when registering and keep it up to date. You are responsible for all activity under your account and for keeping your password secure. Notify us immediately at support@mail.gerbnb.mn of any unauthorised use.

2.3. One person may hold one account unless we agree otherwise in writing. We may refuse, suspend, or terminate an account at our discretion, including for breach of these Terms (see §10).

3. How the Platform works

3.1. Hosts publish listings describing their ger, location, available dates, pricing tier, and house conditions. Guests browse listings, request a booking for specific dates and a pricing tier, and pay the 10% deposit through the Platform.

3.2. A booking is confirmed only when (a) the Host approves the request and (b) the deposit is successfully captured. Until both occur, no booking exists.

3.3. Camp location. To protect Host privacy, the public map shows only an approximate, deliberately offset location for each camp. The exact GPS coordinates are revealed only to a Guest with an upcoming or active booking, about 48 hours before arrival — shown in the app and sent by email or SMS (depending on the contact you have connected). GerBnB checks the camp location with the Host 48–72 hours before arrival (coordinator-mediated). If the camp has moved such that the Guest cannot reasonably reach it, the booking is treated as a Host cancellation under §7.4 and the deposit is refunded in full.

3.4. Bookings may be made up to 30 days in advance within the operating season. The operating season for 2026 is 1 June – 30 September.

4. Price, deposit, and our commission

4.1. The price of the stay is set by the Host, displayed in Mongolian Tögrög (₮), and shown to the Guest before booking, together with any optional add-ons (e.g. breakfast).

4.2. The 10% deposit (our commission). At the time of booking, the Guest pays a deposit equal to 10% of the total booking amount through the Platform. This deposit is GerBnB's service commission and secures the reservation. It is refundable if there is an issue with the stay (see §7).

4.3. The rest is paid directly to the Host. The Guest pays the remaining amount — the price of the stay — directly to the Host at check-in, in cash or another method agreed with the Host. This payment is made outside the Platform. GerBnB does not collect, hold, process, or guarantee it and is not a party to it.

4.4. Deposit processing. The deposit is processed by our payment provider, Bonum, which supports QPay (bank QR) and cards (Visa/Mastercard and other card rails shown at checkout). Payment-provider or bank fees may apply and, where they do, are non-refundable. GerBnB does not store full card numbers.

4.5. You are responsible for any taxes applicable to your own use of the Platform. Hosts are responsible for declaring and paying tax on the hosting income they receive.

5. Guest terms

5.1. When you book, you enter an accommodation contract with the Host on the terms shown in the listing. You agree to pay the 10% deposit at booking and to pay the remaining price of the stay directly to the Host at check-in.

5.2. You agree to: respect the Host, their family, their home, their customs, and their animals; follow the house conditions in the listing; and leave the ger in a reasonable condition. You are responsible for the conduct of anyone you bring with you.

5.3. Remote-travel acknowledgement. You understand that stays take place in remote rural locations. See §9.2 — you voluntarily assume the inherent risks of such travel.

5.4. You may not use the Platform to make speculative, false, or fraudulent bookings, or to arrange any booking that circumvents the Platform to avoid our commission.

6. Host terms

6.1. Eligibility. You confirm that you are entitled to host Guests at the ger/camp you list, that your listing is accurate and not misleading, and that your pricing, location, photographs, and house conditions are correct and current.

6.2. You are the provider. You are the provider of the accommodation and the "seller" of the stay. You are responsible for the stay, for the safety and accuracy of your listing, for disclosing any material hazards, and for complying with applicable local rules.

6.3. Location confirmation. You agree that GerBnB may contact you 48–72 hours before arrival to confirm your camp's exact location, that you will inform GerBnB promptly if you must move or cannot host a confirmed Guest, and that exact coordinates may be shared with the Guest through the Platform about 48 hours before arrival.

6.4. You collect the price directly — GerBnB does not pay out. You receive the price of the stay directly from the Guest at check-in (the total booking amount, less the 10% deposit the Guest has already paid to GerBnB), in cash or another method you arrange. GerBnB does not collect, hold, escrow, or pay out the price of the stay. You authorise GerBnB to retain the 10% deposit as its commission. You are responsible for providing accurate identity and listing details and for any tax on the amounts you receive.

6.5. Host cancellations are governed by §7.4 and may lead to suspension for repeated occurrences.

7. Cancellations and refunds

7.1. What can be refunded. The only payment GerBnB collects is the 10% deposit. The price of the stay is paid directly to the Host at check-in and is never held by GerBnB, so any refund by GerBnB relates only to the deposit. If a stay does not proceed, the Guest simply does not pay the price of the stay to the Host.

7.2. Full deposit refund on a Host or access issue. The Guest receives a full refund of the deposit if: the Host cancels; the Host is absent at the agreed time; the Host fails to confirm the location under §3.3; the camp has moved so that the Guest cannot reasonably reach it; or severe weather, impassable roads, natural disaster, or other force majeure prevents the stay. Late bookings under §7.3a are an exception when the Host does not respond within the approval window.

7.3. Guest cancellation.

• 48 hours or more before check-in: full refund of the deposit.
• Less than 48 hours before check-in, or no-show: the deposit is not refunded (it compensates the Host for holding the date).

7.3a. Late bookings (check-in within 48 hours of booking). You may book with check-in less than 48 hours away. Before you pay, the Platform warns you that Host approval is not guaranteed. If the Host does not approve within the approval window, the deposit is not refunded. Guest cancellation of a late booking follows §7.3 (no refund). If the Host actively declines or cancels after approving, §7.2 and §7.4 still apply and the deposit is refunded. Before booking late, you may contact support (email, phone, or the optional in-app Support chat when analytics cookies are accepted); we will try to help, with no guarantee of a stay.

7.4. Host cancellation. If the Host cancels or the situations in §7.2 apply, the Guest receives a full deposit refund and, where possible, help finding an alternative. Repeated Host cancellations may lead to removal from the Platform.

7.5. How to request and timing. To cancel, use the cancellation function in your account. Deposit refund timing depends on your bank and payment method and is typically 14 business days.

7.6. Nothing in this section limits any non-waivable refund or remedy right a Guest has under the Mongolian Law on Consumer Protection.

8. Acceptable use and content

8.1. You agree not to: break any law; post false, misleading, infringing, or harmful content; harass or endanger any person; introduce malware; scrape or misuse the Platform; or circumvent payment or commission.

8.2. Your content. You keep ownership of the text, photos, and other content you submit. You grant GerBnB a worldwide, non-exclusive, royalty-free licence to host, display, and use that content to operate and promote the Platform. You confirm you have the rights to grant this licence.

8.3. Our content. The Platform, its software, design, and trademarks belong to GerBnB or its licensors. You may not copy or reuse them without permission.

8.4. We may remove content or listings that breach these Terms, and we may moderate the Platform, but we are not obliged to monitor all content.

9. Disclaimers and limitation of liability

9.1. Intermediary only. GerBnB provides the Platform; the Hosts provide the stays. We do not guarantee the accuracy of any listing, the conduct of any Host or Guest, or the condition, quality, or safety of any ger or location, although we take reasonable steps to vet Hosts. The Platform is provided "as is" and "as available" to the maximum extent permitted by law.

9.2. Assumption of risk — remote stays. You acknowledge that stays take place in remote rural and steppe locations and may involve inherent risks, including: livestock and animals (including horses); severe or sudden weather; limited or no mobile-phone coverage; long distances from medical facilities, pharmacies, and emergency services; unpaved or impassable roads; and reliance on the Host for local guidance. You voluntarily assume these risks for yourself and anyone you bring with you.

9.3. No insurance. GerBnB does not provide travel, accident, health, property, or liability insurance, and there is no guest-protection, host-guarantee, or compensation programme. We strongly recommend that Guests obtain their own travel and medical insurance before travelling.

9.4. Direct payment to the Host. The price of the stay is paid directly between Guest and Host, outside the Platform. GerBnB is not responsible for that payment or for any dispute about it (including amounts, cash handling, or change), except for refunding the deposit as set out in §7.

9.5. Limitation of liability. To the maximum extent permitted by applicable law, GerBnB is not liable for any indirect, incidental, or consequential loss, or for the acts or omissions of any Host or Guest. Our total aggregate liability for any claim relating to a booking will not exceed the total amount the Guest paid to GerBnB for that booking (i.e. the deposit).

9.6. Consumer rights preserved. Nothing in §9 excludes or limits liability that cannot be excluded under Mongolian law, including mandatory consumer-protection rights or liability for death or personal injury caused by our own gross negligence or wilful misconduct.

9.7. Indemnity. You agree to indemnify GerBnB against claims, losses, and reasonable costs arising from your breach of these Terms or your misuse of the Platform, to the extent permitted by law.

10. Suspension and termination

10.1. You may close your account at any time. Bookings already confirmed remain subject to §7.

10.2. We may suspend or terminate your access if you breach these Terms, create risk or legal exposure for us or others, or if required by law. Where reasonable, we will give notice. Sums already due (including deposit refunds owed to Guests) remain payable.

11. Governing law and disputes

11.1. These Terms are governed by the laws of Mongolia.

11.2. The parties will try to resolve any dispute amicably first. If they cannot, the dispute will be submitted to the competent courts of Mongolia.

12. Changes, contact, and general terms

12.1. We may update these Terms. We will post the new version with a new effective date and, for material changes, give reasonable notice. Continued use after changes take effect means you accept them.

12.3. If any provision is found invalid, the rest remains in force. These Terms, the Privacy Policy, and the Cookie & Consent Notice are the entire agreement between you and us about the Platform. We may assign these Terms to a successor of our business; you may not assign yours without our consent.

1. Бид хэн бэ, энэ нөхцөл юуг хамаарах вэ

1.1. GerBnB нь Монголын бие даасан малчин, нүүдэлчин өрхийн эзэд (цаашид тус бүрийг «Хост» гэх)-ыг уламжлалт гэрт байрлахыг хүссэн зочидтой (цаашид тус бүрийг «Зочин») холбодог онлайн платформ (цаашид «Платформ»)-ыг ажиллуулдаг. Платформ нь gerbnb.mn болон холбогдох аппликейшнд байршина.

1.2. GerBnB нь зуучлагч бөгөөд байр сууц нийлүүлэгч биш. Бид ямар ч гэр, эд хөрөнгийг эзэмшдэггүй, ажиллуулдагүй, удирддаггүй. Гэрт байрлах үйлчилгээг Хост өөрөө үзүүлнэ. Байрлах гэрээ нь Зочин болон Хост хоёрын хооронд шууд байгуулагдах бөгөөд GerBnB түүний тал болохгүй.

1.3. Бид юуны төлбөр авдаг вэ. GerBnB захиалгын үед зөвхөн 10% урьдчилгаа авах бөгөөд энэ нь бидний үйлчилгээний шимтгэл (§4-ийг үз). Түрээсийн үнийг Зочин ирэх үедээ Хостод шууд төлнө. GerBnB байрлалтын үнийг хэзээ ч авч, хадгалж, шилжүүлдэггүй.

1.4. Та бүртгэл үүсгэх, байр зарлах, эсвэл захиалга хийснээр энэхүү Үйлчилгээний нөхцөл (цаашид «Нөхцөл»), бидний Нууцлалын бодлого, Күүки болон Зөвшөөрлийн мэдэгдлийг хүлээн зөвшөөрөх. Хэрэв та зөвшөөрөхгүй бол Платформыг ашиглах боломжгүй юм.

1.5. Энэ Нөхцөл нь Зочин, Хост гэх бүх хэрэглэгчидэд хамаарна. 5-р зүйл нь зөвхөн Зочинд, 6-р зүйл нь зөвхөн Хостод хамаарах нэмэлт нөхцөлийг тусгана.

2. Эрх олгох болон бүртгэл

2.1. Та 18 насанд хүрсэн бөгөөд Монголын хуулийн дагуу гэрээ байгуулах чадвартай байх ёстой. Платформ нь хүүхдэд зориулагдаагүй.

2.2. Та бүртгүүлэхдээ үнэн зөв, шинэчилсэн мэдээлэл өгч, түүнийгээ байнга шинэчилж байх ёстой. Та өөрийн бүртгэл доорх бүх үйлдэл, нууц үгээ хамгаалах хариуцлагыг өөрөө хүлээнэ. Зөвшөөрөлгүй ашигласан тохиолдолд support@mail.gerbnb.mn хаягаар нэн даруй мэдэгдэнэ үү.

2.3. Бид бичгээр өөрөөр тохиролцоогүй бол нэг хүн нэг бүртгэлтэй байна. Бид нөхцөл зөрчсөн үндэслэлээр бүртгэлийг татгалзах, түдгэлзүүлэх, цуцлах эрхтэй (§10-ыг үз).

3. Платформ хэрхэн ажилладаг вэ

3.1. Хост өөрийн гэр, байршил, боломжит огноо, үнийн шатлал, дотоод журмаа тодорхойлсон зар нийтэлнэ. Зочин зар үзэж, тодорхой огноо, үнийн шатлалаар захиалга өгч, Платформоор дамжуулан 10% урьдчилгааг төлнө.

3.2. Захиалга нь (а) Хост хүсэлтийг зөвшөөрч, (б) урьдчилгаа амжилттай хийгдсэн үед л баталгаажна. Энэ хоёр нөхцөл хангагдах хүртэл захиалга үүсэхгүй.

3.3. Буудлын байршил. Хостын нууцлалыг хамгаалах үүднээс нийтийн газрын зураг дээр гэр бүрийн зөвхөн ойролцоо, барагцаа байршлыг харуулна. Яг GPS координат нь зөвхөн идэвхтэй захиалгатай Зочинд, ирэхээс ойролцоогоор 48 цагийн өмнө апп дотор харагдаж, и-мэйл буюу SMS-ээр (таны холбосон хаягаас хамаарч) илгээгдэнэ. GerBnB зочин ирэхээс 48–72 цагийн өмнө Хосттой байршлыг шалгадаг (координатороор дамжуулан). Хэрэв гэр кемп нүүсний улмаас Зочин хүрэлцэн очих боломжгүй болсон бол захиалгыг §7.4-ийн дагуу Хостын буруутай цуцлалт гэж үзэж, урьдчилгааг бүрэн буцаана.

3.4. Захиалгыг улирлын хүрээнд 30 хүртэл хоногийн өмнө хийж болно. 2026 оны ажиллах улирал нь 6 сарын 1 – 9 сарын 30.

4. Үнэ, урьдчилгаа, шимтгэл

4.1. Түрээсийн үнийг Хост тогтоох ба монгол төгрөгөөр (₮) байх, нэмэлт сонголт (жишээ нь өглөөний цай)-ын хамт захиалга хийгдэхээс өмнө Зочинд харагдана.

4.2. 10% урьдчилгаа (манай апп-ийн шимтгэл). Захиалга хийх үед Зочин нийт захиалгын дүнгийн 10%-тай тэнцэх урьдчилгааг Платформоор дамжуулан төлнө. Энэ урьдчилгаа нь GerBnB-гийн үйлчилгээний шимтгэл бөгөөд онлайнаар төлбөрийг төлж захиалгыг баталгаажуулна. Түрээстэй холбоотой асуудал гарвал урьдчилгааг буцаана (§7-ыг үз).

4.3. Үлдсэнийг Хостод шууд төлнө. Зочин үлдсэн дүн буюу түрээсийн үнийг ирэх үедээ Хостод шууд бэлэн мөнгө эсвэл Хосттой тохирсон бусад аргаар төлнө. Энэ төлбөрийг Платформоос гадуур хийнэ. GerBnB үүнийг авах, хадгалах, боловсруулах, баталгаажуулахгүй бөгөөд ямар ч хамааралгүй болно.

4.4. Урьдчилгааны боловсруулалт. Урьдчилгааг төлбөрийн үйлчилгээ үзүүлэгч Bonum боловсруулна. Bonum нь QPay (банкны QR) болон карт (Visa/Mastercard болон checkout дээр харагдах бусад картын аргууд)-ыг дэмждэг. Банк болон төлбөрийн үйлчилгээний шимтгэл нэмж гарч болзошгүй бөгөөд тэдгээр нь буцаан олгогдохгүй. GerBnB картын бүрэн дугаарыг хадгалдаггүй.

4.5. Та Платформыг ашигласантай холбоотой өөрийн татварыг хариуцна. Хост нь хүлээн авсан хостын орлогынхоо татварыг тайлагнах, төлөх үүрэгтэй.

5. Зочины нөхцөл

5.1. Та захиалга хийснээр зард үзүүлсэн нөхцөлийн дагуу Хосттой байрлах гэрээ байгуулна. Та захиалгын үед 10% урьдчилгааг төлж, түрээсийн үлдэгдэл үнийг очих үедээ Хостод шууд төлөхийг зөвшөөрөх.

5.2. Та дараахийг зөвшөөрнө: Хост, түүний гэр бүл, гэр орон, зан заншилыг хүндэтгэх; зард заасан дотоод журмыг дагах; гэрийг зохистой байдалд орхих. Та дагуулж очсон хүмүүсийнхээ үйлдлийг хариуцах.

5.3. Гэр түрээсийн үйлчилгээ нь алслагдсан хөдөө орон нутагт байна гэдгийг та ойлгох §9.2-ыг үз — иймд гарч болох зарим эрсдэлийг сайн дураар хүлээн зөвшөөрөх.

5.4. Та Платформыг хуурамч, луйврын захиалга хийх ашиглаж болохгүй, эсвэл шимтгэлээс зайлсхийхийн тулд Платформыг тойрсон захиалга зохион байгуулах хориотой.

6. Хостын нөхцөл

6.1. Эрх олгох. Та зарласан гэр/буудалдаа Зочин хүлээн авах эрхтэй, зар тань үнэн зөв бөгөөд төөрөгдүүлээгүй, үнэ, байршил, гэрэл зураг, дотоод журам тань зөв бөгөөд шинэчлэгдсэн болохыг батлах.

6.2. Та бол нийлүүлэгч. Та түрээсийн үйлчилгээг нийлүүлэгч буюу үйлчилгээ «борлуулагч» мөн. Та түрээсийн үйлчилгээ, зарынхаа үнэн зөв байдал, аливаа эрсдэлийг мэдэгдэх, холбогдох орон нутгийн журмыг дагах хариуцлагыг хүлээнэ.

6.3. Байршил баталгаажуулалт. Та зочин ирэхээс 48–72 цагийн өмнө GerBnB таны гэрийн яг байршлыг шалгахыг зөвшөөрч, нүүх шаардлагатай болсон эсвэл баталгаажсан Зочинг хүлээн авах боломжгүй болсон тохиолдолд GerBnB-д нэн даруй мэдэгдэх, мөн яг координатыг Платформоор дамжуулан зочин ирэхээс ойролцоогоор 48 цагийн өмнө Зочинд илгээж болохыг зөвшөөрнө.

6.4. Та төлбөрийг зочидоос шууд авна — GerBnB төлбөр шилжүүлдэггүй. Та түрээсийн төлбөрийг Зочиноос шууд (нийт захиалгын дүнгээс Зочны GerBnB-д аль хэдийн төлсөн 10% урьдчилгааг хассан дүн) бэлэн мөнгө буюу өөрсдийн ярилцсан аргаар авна. GerBnB түрээсийн үнийг авах, хадгалах, барьцаалах, шилжүүлэхгүй. Та GerBnB-д 10% урьдчилгааг шимтгэл болгон үлдээхийг зөвшөөрнө. Та өөрийгөө таниулах болон зарын мэдээллийг үнэн зөв өгөх, мөн шаардлагатай зарим татварыг өөрөө хариуцна.

6.5. Хостын цуцлалт §7.4-ийн дагуу зохицуулагдах ба давтан тохиолдвол түдгэлзүүлэхэд хүргэж болзошгүй.

7. Цуцлалт ба буцаан олголт

7.1. Буцаан олголт. GerBnB зөвхөн 10% урьдчилгааг авдаг. Түрээсийн үлдсэн төлбөрийг Зочин ирэх үедээ Хостод шууд төлдөг бөгөөд GerBnB үүнийг хэзээ ч хариуцахгүй тул GerBnB-гийн буцаалт зөвхөн урьдчилгаанд хамаарна.

7.2. Хостын буруугаас болж цуцлах. Дараах тохиолдолд Зочин урьдчилгааг бүрэн буцаан авна: Хост цуцалсан; Хост тохирсон цагт байгаагүй; Хост §3.3-ын дагуу байршлаа баталгаажуулаагүй; гэр нүүсний улмаас Зочин хүрэлцэн очих боломжгүй болсон; эсвэл хүчтэй цаг агаар, гарц хаагдсан зам, байгалийн гамшиг, бусад давагдашгүй хүчин зүйл байрлалтыг саатуулсан. §7.3a-ын хожуу захиалгад Хост баталгаажуулах хугацаанд хариу өгөөгүй бол энэ заалт хамаарахгүй.

7.3. Хэрэглэгчид олгох буцаан олголт.

• Ирэхээс 48 цаг ба түүнээс өмнө цуцалсан тохиолдолд: урьдчилгааг бүрэн буцаана.
• Ирэхээс 48 цаг-аас бага хугацаа үлдсэн, эсвэл ирээгүй тохиолдолд: урьдчилгаа буцаагдахгүй (энэ нь огноог хадгалсан Хостод нөхөн төлбөр болно).

7.3a. Хожуу захиалга (захиалах үед ирэхэд 48 цагаас бага үлдсэн). Та ирэхэд 48 цагаас бага хугацаа үлдсэн ч захиалж болно. Төлбөр төлөхөөс өмнө Платформ Хостын баталгаа баталгаагүй гэдгийг анхааруулна. Хост баталгаажуулах хугацаанд зөвшөөрөөгүй бол урьдчилгаа буцаагдахгүй. Хожуу захиалгыг Зочин цуцалбал §7.3 хамаарна (буцаалтгүй). Хост идэвхтэй татгалзсан эсвэл зөвшөөрсний дараа цуцалсан бол §7.2, §7.4 хамаарч урьдчилгааг буцаана. Хожуу захиалахаасаа өмнө дэмжлэгтэй холбогдож болно (и-мэйл, утас, эсвэл аналитик күүкийг зөвшөөрсөн үед апп доторх Support чат); бид туслахыг хичээнэ, гэхдээ байр баталгаагүй.

7.4. Хостын цуцлалт. Хост цуцалсан буюу §7.2-ын нөхцөл үүсвэл Зочин урьдчилгааг бүрэн буцаан авах ба боломжтой бол өөр сонголт олоход нь туслана. Хост давтан цуцалбал Платформоос хасагдаж болзошгүй.

7.5. Цуцлах хүсэлт болон хугацаа. Цуцлахын тулд бүртгэл дэх цуцлах цэсээр орно. Урьдчилгааны буцаалтын хугацаа таны банк, төлбөрийн аргаас хамаарах ба ихэвчлэн ажлын 14 өдөр байна.

7.6. Энэ зүйлийн заалт нь Зочины Хэрэглэгчийн эрхийг хамгаалах тухай хуулиар олгогдсон бөгөөд татгалзах боломжгүй буцаан олголт буюу нөхөн төлбөрийн эрхийг хязгаарлахгүй.

8. Зохистой ашиглалт ба контент

8.1. Та дараахийг хийхгүй байхыг зөвшөөрөх: хууль зөрчих; худал, төөрөгдүүлсэн, зөрчилтэй, хортой контент байршуулах; хэн нэгнийг дарамтлах, аюулд оруулах; хортой програм нэвтрүүлэх; Платформыг буруугаар ашиглах; төлбөр, шимтгэлийг тойрох.

8.2. Таны контент. Таны оруулсан текст, гэрэл зураг болон бусад контентын өмчлөл танд хэвээр үлдэнэ. Та GerBnB-д тухайн контентыг Платформоор дамжуулж, сурталчлах зорилгоор байршуулах, харуулах, ашиглах эрхийг \лицензийг төлбөргүй олгох. Энэ лицензийг олгох эрхтэй гэдгээ батлах.

8.3. Бидний контент. Платформ, түүний програм хангамж, дизайн, барааны тэмдэг нь GerBnB эсвэл түүний лиценз эзэмшигчдийнх. Та зөвшөөрөлгүйгээр хуулбарлах, дахин ашиглаж болохгүй.

8.4. Бид Нөхцөл зөрчсөн контент, зарыг устгаж болох ба Платформыг хянаж болох боловч бүх контентыг хянах үүрэг хүлээхгүй.

9. Хариуцлагаас чөлөөлөх ба хариуцлагын хязгаарлалт

9.1. Зөвхөн зуучлагч. GerBnB Платформ нь; Хостууд зараа байршуулах үйлчилгээг үзүүлдэг. Бид Хостуудыг шалгаж стандартын дагуу шаардлага тавьдаг ч аливаа зарын үнэн зөв байдал, Хост, Зочин, эсвэл аль нэг гэр, байршлын байдал, чанар, аюулгүй байдлыг хариуцахгүй. Платформыг хуулиар зөвшөөрөгдсөн дээд хэмжээгээр «байгаа байдлаар нь», «боломжтой хэлбэрээр» хангана.

9.2. Эрсдэлийг хүлээн зөвшөөрөх. Гэр түрээсийн үйлчилгээ нь хөдөө, тал хээр нутагт явагдах бөгөөд дараах эрсдэлийг агуулж болохыг та хүлээн зөвшөөрнө: мал ба амьтад (адуу орно); гэнэтийн цаг агаар; гар утасны сүлжээгүй байдал; эмнэлэг, эмийн сан, яаралтай тусламжаас алслагдсан зай; хучилтгүй зам. Та эдгээр эрсдэлийг өөртөө болон дагуулж очсон хүмүүсийнхээ хувьд сайн дураар хүлээн зөвшөөрнө.

9.3. Даатгал байхгүй. GerBnB аялал, осол, эрүүл мэнд, эд хөрөнгө, хариуцлагын даатгал олгодоггүй бөгөөд зочин хамгаалах, хост баталгаажуулах, нөхөн төлбөрийн хөтөлбөр байхгүй. Зочид аялахаасаа өмнө өөрийн аялал, эрүүл мэндийн даатгалаа хийлгэхийг бид зөвлөж байна.

9.4. Хостод шууд төлөх төлбөр. Түрээсийн төлбөрийг Зочин, Хост хооронд Платформоос гадуур шууд төлнө. §7-д заасны дагуу урьдчилгааг буцаахаас бусад тохиолдолд GerBnB тухайн төлбөр буюу түүнтэй холбоотой аливаа маргаанд (дүн, бэлэн мөнгө, хариулт зэрэг) хариуцлага хүлээхгүй.

9.5. Хариуцлагын хязгаарлалт. Хуулиар зөвшөөрөгдсөн дээд хэмжээгээр GerBnB нь шууд бус, дайвар, үр дагаврын аливаа хохирол, эсвэл аль нэг Хост, Зочины үйлдэл, эс үйлдлийн төлөө хариуцлага хүлээхгүй. Захиалгатай холбоотой аливаа нэхэмжлэлийн хувьд бидний нийт хариуцлага нь Зочин тухайн захиалгын төлөө GerBnB-д төлсөн нийт дүн (буюу урьдчилгаа)-аас хэтрэхгүй.

9.6. Хэрэглэгчийн эрх хадгалагдана. §9-д заасан зүйл нь Монголын хуулиар хасах боломжгүй хариуцлага — тэр дунд хэрэглэгчийн эрхийг хамгаалах заавал биелүүлэх эрх, эсвэл бидний өөрсдийн ноцтой хайхрамжгүй байдал, санаатай үйлдлээс үүдсэн нас баралт, бие махбодийн гэмтлийн хариуцлагыг хязгаарлахгүй.

9.7. Хохирол барагдуулалт. Та Нөхцөлийг зөрчсөн, Платформыг буруугаар ашигласнаас үүдсэн нэхэмжлэл, хохирол, боломжит зардлаас GerBnB-г хуулиар зөвшөөрөгдсөн хэмжээгээр хохиролгүй байлгахыг зөвшөөрнө.

10. Түдгэлзүүлэх ба цуцлах

10.1. Та хүссэн үедээ бүртгэлээ хааж болно. Аль хэдийн баталгаажсан захиалга §7-д захирагдсан хэвээр үлдэнэ.

10.2. Та Нөхцөлийг зөрчсөн, бидэнд буюу бусдад эрсдэл, эрх зүйн хариуцлага учруулсан, эсвэл хуулиар шаардсан тохиолдолд бид таны хандалтыг түдгэлзүүлэх, цуцалж болно. Боломжтой бол урьдчилан мэдэгдэнэ. Аль хэдийн төлбөл зохих дүн (Зочинд буцаах урьдчилгааны буцаалт зэрэг) төлөгдөх ёстой хэвээр үлдэнэ.

11. Үйлчлэх хууль ба маргаан шийдвэрлэлт

11.1. Энэ Нөхцөл Монгол Улсын хууль-иар зохицуулагдана.

11.2. Талууд аливаа маргааныг эхлээд эвийн журмаар шийдвэрлэхийг хичээнэ. Боломжгүй бол маргааныг Монгол Улсын эрх бүхий шүүх-эд хандана.

12. Өөрчлөлт, холбоо барих, ерөнхий нөхцөл

12.1. Бид энэ Нөхцөлийг шинэчилж болно. Шинэ хувилбарыг шинэ хүчин төгөлдөр болох огноотойгоор нийтлэх ба томоохон өөрчлөлтийн талаар урьдчилан мэдэгдэнэ. Өөрчлөлт хүчин төгөлдөр болсны дараа үргэлжлүүлэн ашиглавал та хүлээн зөвшөөрсөнд тооцно.

Бид энэ Нөхцөлийг бизнесийн залгамжлагчдаа шилжүүлж болох ба та бидний зөвшөөрөлгүйгээр өөрийнхөө эрхийг шилжүүлж болохгүй.
